If you do not accept these Terms, you must not use our Service. Your use of the Service constitutes explicit acceptance of these Terms.

You declare and warrant that you are at least 18 years old or the age of legal majority in your jurisdiction, and that you have the legal capacity to enter into these Terms.

1.3. Modifications to Terms

We reserve the right to modify these Terms at any time. Modifications will take effect immediately upon their publication on the Platform. Your continued use of the Service after the publication of modifications constitutes your acceptance of the modified Terms.

2. Service Description

stickfigure.video is an artificial intelligence-based video animation generation service that allows users to create animated videos from reference images and text.

2.1. Service Features

  • Image Generation: Use of the Google Gemini API to analyze your reference images and generate consistent images for your animations.
  • Voice Synthesis: Use of the ElevenLabs API to convert your text into high-quality synthetic voices.
  • Video Generation: Automatic assembly of images and audio to create final animated videos.

2.2. Service Provided "As Is"

The Service is provided "AS IS" and "AS AVAILABLE".

  • We do not guarantee that the Service will be uninterrupted, secure, or error-free.
  • The Service depends on the availability and proper functioning of third-party APIs (Google Gemini, ElevenLabs). We are not responsible for interruptions, failures, or limitations of these third-party services.
  • We reserve the right to modify, suspend, or interrupt all or part of the Service at any time, with or without notice.

2.3. Availability and Maintenance

We strive to ensure maximum availability of the Service, but we do not guarantee 100% availability. The Service may be temporarily unavailable for maintenance, updates, or for technical reasons beyond our control.

3. Credits System

Our Service operates on a credits system. Credits are required to generate videos and use premium features of the Service.

3.1. Purchased Credits - Non-Refundable

Purchased credits are NOT refundable once used to generate a video.

  • Once a credit is used to generate a video, it is permanently consumed and cannot be refunded, even if the generated video does not meet your expectations.
  • Unused credits may be kept indefinitely in your account, but are not refundable in cash.
  • In case of a technical problem beyond your control preventing the complete generation of a video, we may, at our sole discretion, credit your account with the used credits.

3.2. Free Credits - Restrictions

We offer 30 seconds of free credit to allow you to test our Service. These free credits are subject to the following restrictions:

  • Watermark: Videos generated with free credits contain a visible watermark indicating they were created with stickfigure.video.
  • Reduced Resolution: Videos generated with free credits are produced in reduced resolution compared to videos generated with paid credits.
  • One-Time Use: Free credits can only be used once per user account.

To obtain videos without watermark and in high resolution, you must purchase paid credits.

3.3. Purchasing Credits

  • Credits can be purchased through our secure payment platform.
  • Credit prices are clearly indicated on the Platform and may be modified at any time.
  • Purchased credits are immediately credited to your account after payment confirmation.

4. Intellectual Property

4.1. User Rights

You retain all intellectual property rights on:

  • Your Reference Images: You retain all rights to the images you upload and use as style references.
  • Your Texts and Scripts: You retain all rights to the texts you provide for voice and script generation.
  • Your Generated Videos: Once generated, you obtain usage rights to the videos created with our Service, subject to compliance with these Terms.

4.2. Responsibility for Generated Content

You are entirely responsible for the content you generate with our Service.

You agree NOT to use our Service to generate content that is:

  • Illegal: Content violating applicable laws (defamation, harassment, incitement to hatred, etc.)
  • Hateful or Offensive: Content promoting discrimination, violence, or violating human dignity.
  • Protected by Copyright: Content violating third-party intellectual property rights (images, texts, trademarks, etc.)
  • Pornographic or Explicit: Sexual or violent content that is inappropriate.
  • Deceptive or Fraudulent: Content intended to deceive, defraud, or harm others.

4.3. Consequences of Non-Compliance

In case of violation of these rules, we reserve the right to:

  • Suspend or immediately terminate your account
  • Delete the violating content
  • Refuse any refund of used credits
  • Take appropriate legal action

4.4. Service Intellectual Property

The Service itself, including its source code, design, logos, and all elements of the Platform, are the exclusive property of stickfigure.video and are protected by intellectual property laws.

5. Payments and Subscriptions

5.1. Merchant of Record

Lemon Squeezy is our official reseller ("Merchant of Record") and handles all aspects of billing and payments:

  • Billing: Lemon Squeezy issues all invoices for your credit purchases.
  • Tax Management: Lemon Squeezy calculates, collects, and remits all applicable taxes (VAT, sales taxes, etc.) in accordance with applicable legislation.
  • Payment Processing: All payments are processed securely by Lemon Squeezy.
  • Customer Support: For any questions regarding billing or payments, contact Lemon Squeezy directly.

5.2. Prices and Taxes

  • Prices displayed on the Platform may not include applicable taxes.
  • Taxes will be calculated and added during the payment process by Lemon Squeezy.
  • Prices may be modified at any time, but will not affect credits already purchased.

5.3. Payment Methods

We accept payment methods offered by Lemon Squeezy, which may include credit cards, debit cards, and other electronic payment methods.

6. Limitation of Liability

6.1. Artificial Intelligence Results

We are NOT responsible for results generated by artificial intelligence.

AI technologies can produce unpredictable results, including:

  • Hallucinations: AI may generate elements that do not exist in the reference image or that are incorrect.
  • Pose Errors: Stickman poses may not exactly match your intention or the reference image.
  • Visual Inconsistencies: Generated images may have inconsistencies, artifacts, or defects.
  • Variable Quality: Result quality may vary depending on many factors (reference image quality, scene complexity, etc.)

You accept that using AI involves risks and that results may not always meet your expectations.

6.2. Service Interruptions

We are not responsible for service interruptions caused by:

  • Failures or interruptions of third-party APIs (Google Gemini, ElevenLabs)
  • Network or connectivity issues
  • Planned or emergency maintenance
  • Force majeure (natural disasters, cyberattacks, etc.)

6.3. General Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim related to the Service is limited to the amount you paid to use the Service in the last 12 months, or 100 euros, whichever is greater.

We will in no case be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

6.4. No Warranty

The Service is provided without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Termination

7.1. Termination by User

You may terminate your account at any time by contacting us or using the account deletion function in your profile settings.

Upon termination:

  • Your access to the Service will be immediately suspended
  • Your personal data will be deleted in accordance with our Privacy Policy
  • Unused credits will not be refunded

7.2. Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice or refund, in case of:

  • Free Credits Fraud: Attempt to obtain free credits fraudulently (creating multiple accounts, using automated systems, etc.)
  • API Spam: Abusive use of our API or services (excessive requests, unauthorized automation, etc.)
  • Terms Violation: Non-compliance with any provision of these Terms
  • Prohibited Content: Generation of illegal, hateful content or content violating others' rights
  • Suspicious Activity: Any activity we deem suspicious, fraudulent, or harmful to our Service or users

7.3. Consequences of Termination

In case of termination, whether initiated by you or by us:

  • Your right to use the Service immediately ends
  • We may delete or disable your account and all associated content
  • Unused credits will be lost without refund
  • We will not be liable to you or any third party for the termination

8. Modifications to Terms

We reserve the right to modify these Terms at any time. Modifications will be published on this page with an update to the "Last Updated" date.

8.1. Notification of Modifications

For significant modifications, we will notify you by email to the address associated with your account or via a notification on the Platform.

8.2. Continued Acceptance

Your continued use of the Service after the publication of modifications constitutes your acceptance of the modified Terms. If you do not accept the modifications, you must stop using the Service and terminate your account.

9.1. Applicable Law
